Creating IEPs with Generative AI While Protecting Student Data Privacy

Generative AI is starting to appear in special education workflows, including support for drafting Individualized Education Programs (IEPs). Used carefully, it can help educators summarize data, suggest accommodations, and streamline documentation. But because IEPs contain highly sensitive student information, any use of AI in this space raises serious privacy, ethical, and compliance considerations.

The goal is not to avoid AI entirely—it is to use it in ways that protect student confidentiality while still improving educator efficiency.

1. Start with a strict “no raw student data” rule

One of the most important safeguards is controlling what is entered into AI systems. Schools should avoid inputting identifiable student information into public or unsecured AI tools.

Instead of names, diagnoses, or specific case details, educators can use:

  • De-identified summaries
  • Generalized learning profiles
  • Abstracted skill descriptions

For example, replace “Student A, diagnosed with dyslexia, struggles with decoding in grade-level texts” with “middle school student with significant reading decoding challenges.”

2. Use approved, district-controlled AI environments

Not all generative AI tools are designed for educational or secure use. Schools should prioritize platforms that offer:

  • FERPA-aligned or equivalent privacy protections
  • Data isolation (no training on student inputs)
  • Admin-level controls and audit logs
  • Secure storage and encryption

When possible, AI tools should be deployed within district-managed environments rather than open public interfaces.

3. Treat AI as a drafting assistant, not a decision-maker

AI can support IEP creation by:

  • Summarizing teacher notes
  • Reorganizing accommodation lists
  • Suggesting clearer wording for goals
  • Helping align language with compliance requirements

However, it should never replace professional judgment. Final decisions about goals, services, and accommodations must remain with qualified educators and support staff.

4. Build human review into every step

Every AI-generated suggestion should be reviewed, edited, and validated by the IEP team. This includes:

  • Special education teachers
  • School psychologists
  • Case managers
  • Parents or guardians (as appropriate)

AI can assist with clarity and structure, but accountability must remain human-centered.

5. Be transparent with stakeholders

Families and educators should understand when and how AI is being used in the IEP process. Transparency builds trust and helps ensure ethical compliance.

Schools may consider:

  • Noting AI assistance in internal documentation workflows
  • Communicating that AI is used only for drafting support, not decision-making
  • Providing clear opt-out or review assurances where required

6. Align with legal and compliance frameworks

IEPs are governed by strict legal protections, including IDEA in the United States and related privacy laws like FERPA. Any AI use must align with:

  • Data minimization principles
  • Secure record-keeping requirements
  • Parental rights to access and review records
  • Retention and deletion policies

If a tool cannot meet these requirements, it should not be used for IEP-related work.

7. Focus on accessibility and clarity in output

One of AI’s strengths is improving readability. When used appropriately, it can help ensure IEPs are:

  • Clear and jargon-free for families
  • Consistent in structure and formatting
  • Easier to navigate for educators across teams

This can improve collaboration without altering the substance of educational decisions.

The bigger picture

Generative AI has the potential to reduce administrative burden in special education, giving educators more time to focus on students rather than paperwork. But in the context of IEPs, the stakes are high. Privacy, compliance, and trust must guide every decision.

Used responsibly, AI becomes a support tool—not for writing IEPs instead of educators, but for helping educators write them more clearly, efficiently, and accessibly while keeping student data fully protected.
